Two sides. One argues that the 14th Amendment enshrines birthright citizenship for all. The other side argues that the phrase “and subject to the jurisdiction thereof” renders babies born to non-citizens as fellow non-citizens:
The plaintiffs argue the amendment, which holds that “all persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside,” are indisputably citizens.
The Trump administration has asserted that children of noncitizens are not “subject to the jurisdiction” of the United States and therefore not entitled to citizenship.
About three dozen countries offer birthright citizenship, most in the Western hemisphere. Canada and the U.S. are the two most developed countries to offer it. Mexico and Brazil also offer it. The only other country in the West that doesn’t offer it is Colombia. Outside of the west, only Chad and Tanzania offer it.

ParticipantIMO, Trump is fighting an uphill battle. He is trying to head butt wording in the 14th, twisting to suit his own definition. Courts have ruled on this several times, each time ruling against what Trump is trying to do.
Again, just my opinion, he should accept birthright citizenship for those whose parents are here legally. That would be green card holders, those with visas, etc.
Seems like he would have a shot a winning the argument those who are here legally ARE under the jurisdiction of the US.
